Withdrawal Instructions

Cancellation Policy

Consumers residing in the EU have a right of withdrawal for distance contracts, whereby a consumer is any natural person concluding a contract for purposes not related to their trade, business, or profession.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days and starts, for purchases of goods and other contracts aimed at the acquisition of goods for consideration, from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods, or in the case of partial deliveries, the last good.

For the order of pure services such as planning, surveying, and consulting, the following applies:

You can withdraw from the contract within 14 days without giving any reason in text form (e.g., letter, fax, email). The period begins from the conclusion of the contract.

Exercising the Right of Withdrawal

To exercise your right of withdrawal, you must inform us

by means of a clear statement (e.g., a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, which is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will have to bear the direct cost of returning the goods. However, for goods which by their nature cannot normally be returned by post (freight goods), we shall collect the goods at our own expense.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion or Early Expiry of the Right of Withdrawal

The right of withdrawal does not apply to consumers who do not have their residence in the EU.

You also have no right of withdrawal for contracts concluded away from business premises where the price you are to pay does not exceed the amount of 50 euros.

Furthermore, the right of withdrawal does not apply to goods made to customer specifications or clearly personalized.

[Alternatively: We only conclude contracts for the supply of goods made to customer specifications or clearly personalized, and therefore, in accordance with Section 18 FAGG, no right of withdrawal exists.]

The right of withdrawal also does not apply to services if the trader has, at the express request of the consumer, commenced performance of the contract before the end of the withdrawal period, and if the consumer:

• a) either confirmed before the start of the service provision that they have taken note that they lose their right of withdrawal upon full performance of the contract, or
• b) expressly requested the trader to make a visit in order to carry out repair work.

If the consumer withdraws from a contract for services after having, by their order, requested performance of the contract before the end of the withdrawal period and the trader has thereupon commenced performance of the contract, the consumer must pay the trader an amount which is proportionate to the services provided by the trader until withdrawal, compared to the full coverage of the contract.
